Photography contest rules & regulations
"Photograph your most inconceivable encounters while traveling by air"Air France, a business corporation with a capital of €1,901,231,625.00, duly registered at the Bobigny Business Registry under number 420 495 178, with registered head office located at 45 rue Paris 95747, Roissy CDG, (hereinafter referred to as "Air France" or the "Event Organizer") is organizing a photo contest entitled: "Photograph your most inconceivable encounters while travelling by air".
The contest will be held from August 7th to midnight January 31st, 2010.
Article 2 - Participants
The contest is open to any and all natural persons of age and of any nationality, excluding members of contest jury, and in general, any persons having assisted in contest organization process and completion, the entire staff of the Air France –KLM Group.
Participation in the contest is strictly nominative (limited to a single person, same name, same address). Each candidate may submit up to a maximum of 5 photos.
Participation in the contest is subject to the competitor personally being the photographer. Said candidate duly attests to being the unique holder of intellectual property rights for the photograph(s) submitted by same.
Article 3 - Registration and participation conditions
The participant must possess an Internet connection and valid email address for registration purposes. Participation in the contest occurs in two phases:
3.1 Registration : the photo contest will be visible from August 7 to January 31, 2010 on the Bluenity website homepage: http://www.bluenity.fr/ or http://www.bluenity.com and any other associated URLs with the Bluenity domain name.
To register for the photo contest, the candidate must complete prior registration procedures on the Bluenity site via the available registration form.
Any incorrect or incomplete registrations will not be processed and will render participation null and void.
3.2 Participation : following registration on the Bluenity site, the candidate may submit contest photo(s) without any restriction as to specific formatting (size not to exceed 4 megabytes), and fill in the following fields:
- Geographic position of the shot
- Possibility of naming the photo
The above information will be sent to a moderation system.
The Event Organizer will not be held liable in the case of non-reception of candidate photographs, namely in the case of loading the photograph after participation closing time and date.
Any photos submitted following the January 31, 2010 closing date will not be processed as a contest candidate, rendering participation null and void.
Article 4 - Submission topic
The topic of this contest is "The most inconceivable encounter(s) while travelling by air". Only those photographs treating one of the following topics will be judged and only if compliant with Article 5:
- The most inconceivable encounter(s)
- The most original / bizarre encounters while travelling by air
Article 5 - Rules regarding photographic shots
The photographs presented at the photo contest must not have been published previously.
Only picture touch-ups and chromatometrics (density, saturation, contrast, etc.) are admitted. Such changes must be specifically stated in an attachment to the sent photograph. No other editing will be accepted. The jury reserves the right to request that candidate provide the .raw file for a digital photo or a negative duplicate for a digitized silver print photo.
Air France would like to remind candidates that picture-taking may be prohibited or subject to obtaining administrative authorization around several airports throughout the world. Air France will not be held liable for any participant who does not comply with local regulations.
Article 6 - The juries
Jury 1 is formed of Bluenit members, that is, holders of an http://www.bluenity.fr/ or http://www.bluenity.com. It is hence a popular jury which will select the first prize winning photograph based on its majority preference.
Jury 2 is formed of Air France KLM, Tripnity, Nature et Découvertes (Canopée Magazine) members. It will select the 2nd and 3rd prize winning photos based on 2 criteria: originality and aesthetics.

The Juries will rule without appeal and no recourse against their decisions may be admitted.
The composition and number of jury members may be modified at any time according to contest needs.
Article 7 - Prizes / endowments
The totality of the photographs will undergo classification and the 3 best photographs awarded a prize, based on following criteria:
- election by Jury 1 of its favourite photograph (1st prize)
- election by Jury 2 of the most original photograph (2nd prize)
- election by Jury 2 of the most aesthetic photograph (3rd prize)
Contest endowments are composed of 3 prizes:
1st Prize
2 tickets worth €1,600 (less tax) for a long-haul flight, destination of own choice in economy class (Voyageur) on any Air France self-operated lines. It is duly noted that said tickets must be construed as being 2 Return travel passes usable on flights of the Air France network. Said passes must be used solely by the winner and any persons of his/her choice and are subject to specific conditions. Said tickets, subject to specific conditions, must be booked between January 15th and June 30th, 2010 and used prior to May 1st, 2011, deadline for the return trip; failure to comply with same, said tickets will be lost. The tickets are non-changeable, non-refundable and non-exchangeable. Winning tickets are excluded from the Flying Blue plan. Winners who are members of said plan, as well as their accompanying parties cannot accumulate miles on the complimentary trip. Transportation costs alone are borne by the Air France Company. Airport taxes and any other costs incurred by the winner are charged to winner. In the case of a tie, the Air France KLM jury will choose a winner from the photos with the same number of votes.
2nd Prize
2 tickets worth €800 (less tax) for a medium-haul flight, destination of own choice in economy class (Voyageur) on any Air France self-operated lines. It is duly noted that the 2 Return travel passes forming a batch for 2 travellers must be booked jointly and used on the same Air France flights. It is duly noted that said tickets must be construed as being 2 Return travel passes usable on flights of the Air France network. Said passes must be used solely by the winner and any persons of his/her choice and are subject to specific conditions. Said tickets, subject to specific conditions, must be booked between January 15th and June 30th, 2010 and used prior to May 1st, 2011, deadline for the return trip; failure to comply with same, said tickets will be lost. The tickets are non-changeable, non-refundable and non-exchangeable. Winning tickets are excluded from the Flying Blue plan. 3rd Prize

Article 8 - Naming of the winners
The list of contest winners will be made public on the Website as of the month of March 2010.
The awarded photographs will be in the form of a slide show on the Bluenity site.
Article 9 - Conditions of awarding the prize and usage
Contest winners may pick-up their prizes as of March 15, 2010. At this time, Ms. Chantal Lacaze from the Air France – KLM Marketing Department, will contact winners by telephone, or, if not, by e-mail one week following publication of results for purposes of awarding the prizes.
Regarding prizes requiring winner participation or travel, validity deadline for such prizes will be May 1st, 2011.
Air France reserves the right to acquire further information for purposes of awarding the various prizes, such as a complete address or telephone number.
The endowments can in no case whatsoever be taken back or exchanged against their cash value or against another endowment, nor transmitted to a third party. However, in the case of an Act of God, or should circumstances so require, the Event Organizer reserves the possibility of substituting other endowments of equivalent value to the proposed endowments, at any time.
Conditions of booking and use of the prizes appear in Article 7.
Article 10 - Intellectual property rights
Photographer participants authorize Air France and KLM, on a gratuitous basis: to publish and/or exhibit the photographs on any Bluenity communications mediums related to this contest: website, other Air France and KLM communications mediums, Natures et Découvertes communications mediums (Canopée Magazine in particular).
The authorization for use herein carries the possibility for Air France to possibly modify, adapt, reframe, touch-up and/or accompany the photographs with written commentary according to its needs and requirements for usage purposes.
The said authorization is granted free of charge and no remuneration other than awarding of the prize may be demanded by participants as a counterpart to such authorization.
Air France agrees to comply with the moral rights of each creative artist, such as name, title and creation. Winner names will appear on all forms of usage of their creative work.
The candidates agree that their creative work is not to obstruct the rights of third parties in any manner whatsoever, such as the right of publicity and guarantees Air France against any recourse or claim in this regard.
Should a photo violate the rights or integrity of a natural person or legal entity, public decency (prohibition of nudity, racial or religious violation in particular, etc.), Air France reserves the right to withdraw same from the contest.
However, should the winners not wish their names, addresses or photographs be used within the aforementioned framework, they may request this be forbidden in writing, sent by registered mail prior to January 31st, 2010, addressed to:

Article 11 - Event organizer liability
Air France reserves the right to cutting short, postponing, modifying or cancelling the contest without having to provide any justifying reasons and without Air France being held liable for same.
Air France is released from any liability as regards total cancellation of the operation, should such a decision be beyond its control.
Should this be the case, Air France agrees to inform registered participants of the cancellation or postponement of the contest via the dedicated Website page.
Furthermore, Air France will not be held liable in any manner whatsoever in the case of degradation, loss or theft of the submitted projects. Finally, Air France will not be held liable should access to website links prove to be difficult or impossible for participants.
Article 12 - Personnal data
Any nominative information gathered within the context of the draw herein is handled in compliance with the January 6, 1978 Act, known as the Privacy Act ('Informatique et Libertés'). The participants are informed that any data of a personal nature concerning themselves and registered within the framework of this contest are indeed required for processing their participation.
All participants, in application of Article 39 of said Act, hold a right of access and correction of data concerning themselves. Any requests for access, correction or opposition must be addressed to:

Participation in this contest implies acceptance, without any restrictions nor reservations, of the Rules & Regulations herein as well as waiving any recourse against the decisions taken by the Event Organizer and the Jury.
The original text of said Rules & Regulations is drafted in French and in English. Should a disagreement arise between the original French text and the established English version, the original in French will prevail.
